PHOTOGRAPHY SESSION SERVICE AGREEMENT
This Photography Session Service Agreement (“Agreement”) is entered into by and between Stephen Parvaresh of S&P Productions, LLC (“Photographer”) and the undersigned client (“Client”) for the purpose of providing photography services as outlined in the booking.
This Agreement applies to all photography services offered by the Photographer, including but not limited to: in-home lifestyle sessions, studio portraits, corporate events, engagement sessions, elopements, maternity sessions, and other on-location or in-home photography services.
1. SCOPE OF SERVICES
1.1 Session Types
This Agreement covers all photography services provided by the Photographer, including but not limited to: in-home lifestyle sessions, portrait sessions, corporate events, engagement sessions, elopements, maternity sessions, and other on-location or in-home photography sessions.
1.2 Service Location Radius
The Photographer offers services within a 40-mile radius of Austin, TX. Requests for services beyond this radius must be approved in writing before booking and may be subject to additional fees or limitations.
2. PAYMENT TERMS
2.1 Deposit
A non-refundable deposit of 10% of the base session fee is required at the time of booking to secure the session date and time. The deposit will be applied toward the total session fee.
2.2 Final Payment
The remaining balance is due at the time of the session. Payment may be made via the Photographer’s booking platform (Setmore) or directly to the Photographer.
3. RESCHEDULING & CANCELLATIONS
3.1 Client Cancellations & Rescheduling
The Client may cancel or reschedule a session with at least 24 hours’ notice. Cancellations made with less than 24 hours’ notice will result in forfeiture of the 10% deposit
3.2 Photographer Cancellations
In the event the Photographer must cancel due to illness, equipment failure, or unforeseen circumstances, the Client may choose to reschedule or receive a full refund, including any deposit paid.
3.3 Weather Conditions (for Outdoor Sessions)
For outdoor sessions, if weather conditions are unfavorable, the Photographer will work with the Client to reschedule at no additional cost.
4. SESSION CONDUCT
4.1 Client Responsibilities
The Client is responsible for providing a safe, clean, and adequately lit environment for the session, particularly for in-home or private location sessions. The Photographer is not liable for injuries, damages, or accidents occurring during the session.
4.2 Cooperation & Conduct
The Client agrees to follow the Photographer’s directions to achieve the best results. Uncooperative behavior by adults, children, or pets may affect the number or quality of images delivered.
4.3 Event Coverage (If Applicable)
For sessions or events exceeding 4 hours, the Photographer is entitled to a brief meal break. If meals are provided to other vendors, the Photographer kindly requests to be included. This ensures continuous coverage without interruption.
Additional time beyond the booked duration may incur an hourly fee, to be agreed upon in advance.
4.4 Late Arrival / No-Show
Clients arriving more than 15 minutes late without notice may forfeit time from their session. If the Client does not arrive within 30 minutes of the scheduled time without communication, the session will be considered a no-show, and the session fee will not be refunded.
4.5 Equipment & Property Liability
The Client is responsible for any damage to the Photographer’s equipment or property caused by themselves, guests, or pets during the session.
4.6 Minors
If minors are present during the session, a parent or legal guardian must be present at all times and provide consent for the photography of the minor(s).
5. IMAGE DELIVERY & EDITING
5.1 Turnaround Time
Proof images will be provided within 5 days of the session if specified. Final edited images will be delivered within 2 weeks.
5.2 Image Selection & Editing
The session includes a set number of final edited images, as specified in the booking. The Client may select their preferred images for editing. Additional edited images may be requested for a fee.
5.3 Image Format & Access
Final images will be delivered digitally via a Google Photos gallery. RAW (unedited) files will not be provided.
5.4 Editing Style
The Photographer will edit images in their signature style. Additional editing requests beyond the agreed deliverables will not be accommodated unless discussed separately.
5.5 Image Backup
The Photographer will store final edited images for 60 days after delivery. It is the Client’s responsibility to download and securely store their images. Additional copies beyond this period may not be available.
6. COPYRIGHT & USAGE RIGHTS
6.1 Copyright Ownership
By default, the Photographer retains full copyright to all images captured during the session in accordance with U.S. copyright law.
6.2 Personal Use License
The Client is granted a non-exclusive, non-transferable license to use the final images for personal purposes, including printing, sharing on social media, and other non-commercial use.
6.3 Commercial Use & Copyright Purchase
If the Client wishes to use the images for commercial purposes (e.g., marketing, advertising, publishing), a separate commercial license must be purchased. In certain cases, the Client may also request to purchase full copyright ownership of the images for an additional fee, subject to the Photographer’s approval and a written agreement transferring those rights.
6.4 Model Release
The Client grants the Photographer permission to use images for portfolio, website, social media, and marketing purposes. If the Client does not wish to grant this permission, it must be communicated in writing prior to the session.
7. LIMITATION OF LIABILITY
7.1 Technical or Equipment Failures
In the rare event of image loss due to equipment malfunction or technical issues, the Photographer’s liability is limited to a refund of payments received or a reshoot, at the Photographer’s discretion.
7.2 Force Majeure
Neither party shall be held liable for failure to perform due to causes beyond their control, including but not limited to natural disasters, acts of God, illness, or government restrictions.
8. SATISFACTION & REFUNDS
8.1 Refund Policy
No refunds will be issued once the session has been completed and images delivered. The Photographer will make every effort to provide high-quality work and client satisfaction.
8.2 Reshoots
In the event of technical issues or other extraordinary circumstances, the Photographer may offer a complimentary reshoot at their sole discretion.
9. ENTIRE AGREEMENT
This Agreement constitutes the entire understanding between the Client and Photographer and supersedes any prior agreements, communications, or discussions. Any amendments must be made in writing and signed by both parties.
ACKNOWLEDGEMENT
By booking a session with Stephen Parvaresh, S&P Productions, LLC, the Client acknowledges that they have read, understood, and agreed to the terms and conditions outlined in this Agreement. Policies regarding travel fees, rescheduling, and session expectations are subject to change and will be communicated prior to session.
